Honeysuckle Flower Preservation LLC is a limited liability company organized under the laws of the State of Texas. All contracts, transactions, and obligations entered into through this website are solely with Honeysuckle Flower Preservation LLC and not with its individual members, managers, or representatives.

This website is operated by Honeysuckle Flower Preservation LLC. Throughout the site, the terms “we”, “us”, and “our” refer to Honeysuckle Flower Preservation LLC. We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site, placing an order, or submitting flowers to us, you engage in our Service and agree to be bound by these Terms of Service, including additional policies referenced herein. These Terms apply to all users of the site, including browsers, customers, and contributors of content.

If you do not agree to these Terms, you may not access the website or use our Services.

Our store is hosted on Shopify Inc., which provides the e-commerce platform allowing us to offer products and services to you.

We may update these Terms of Service at any time by posting changes on this page. Continued use of the website constitutes acceptance of those changes.

SECTION 1 - ONLINE STORE TERMS

You represent that you are at least the age of majority in your state of residence or have permission from a legal guardian to use this site. You may not use our services for any unlawful or unauthorized purpose or violate any applicable laws. You must not transmit viruses or destructive code. Violation of any Terms may result in termination of access to our Services.

We reserve the right to refuse service to anyone at any time for any lawful reason. Content you submit (excluding payment information) may be transferred over networks and adapted to technical requirements. Payment information is encrypted during transmission. You may not copy, reproduce, resell, or exploit any portion of the Service without written permission.

Information on this site is provided for general informational purposes only. We do not guarantee that all information is accurate, complete, or current. Reliance on the material on this site is at your own risk. We may modify site content at any time without obligation to update it.

SECTION 5 - PRODUCTS AND SERVICES

Flower preservation is a custom commissioned service performed using materials provided by the customer. Because each project is unique and cannot be resold, results will vary. We make reasonable efforts to display colors and images accurately but cannot guarantee display accuracy on individual devices.

We reserve the right to limit or refuse orders and to discontinue services at our discretion.

SECTION 6 - BILLING AND ACCOUNT INFORMATION

You agree to provide accurate and current purchase and contact information. We may cancel or limit orders at our discretion and attempt notification using provided contact information. Failure to provide accurate information may delay or prevent completion of services.

SECTION 7 - THIRD-PARTY TOOLS

We may provide access to third-party tools “as is” and without warranties. Use of third-party tools is at your own risk and subject to the third party’s terms.

SECTION 8 - THIRD-PARTY LINKS

We are not responsible for third-party websites linked on our site and assume no liability for any third-party content, products, or services.

SECTION 9 - USER SUBMISSIONS

By submitting comments, reviews, or media, you grant us permission to use, publish, and reproduce such materials without compensation. You represent that your submissions do not violate any third-party rights.

Our services and website are provided “as is” and “as available.” We do not guarantee uninterrupted or error-free service. To the maximum extent permitted by law, Honeysuckle Flower Preservation LLC shall not be liable for indirect, incidental, special, or consequential damages arising from use of our services or products.

SECTION 14 - INDEMNIFICATION

You agree to indemnify and hold harmless Honeysuckle Flower Preservation LLC and its members, employees, contractors, and affiliates from claims arising from your breach of these Terms or violation of law.

SECTION 15 - SEVERABILITY

If any provision of these Terms is determined unenforceable, the remaining provisions remain in effect.

SECTION 16 - TERMINATION

We may terminate or suspend access to our services if you violate these Terms. All payment obligations incurred prior to termination remain due.

SECTION 17 - ENTIRE AGREEMENT

These Terms and related policies constitute the entire agreement between you and Honeysuckle Flower Preservation LLC and supersede prior communications.

SECTION 18 - GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide services shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.

Any dispute, claim, or legal proceeding arising from or relating to our services, these Terms, or any order placed with us shall be brought exclusively in a court of competent jurisdiction located within the State of Texas, and venue shall lie in the county of our principal place of business at the time the claim arises.

SECTION 19 - CHANGES TO TERMS

We may update these Terms at any time. Continued use of the site constitutes acceptance of updated Terms.

SECTION 20 - SHIPPING ADDRESS

Orders are shipped to the address provided at checkout. Customers are responsible for providing an accurate address prior to shipment. We are not responsible for packages delivered to incorrect addresses supplied by the customer.

SECTION 21 - CUSTOM ORDERS, CANCELLATIONS, AND REFUNDS

Flower preservation is a commissioned custom service scheduled in advance. Each order reserves studio calendar space, planning time, and production capacity that cannot be reassigned to another client.

Booking Retainer and Order Changes

The $100 booking retainer reserves studio production time and project preparation. If a customer reduces or modifies their order after flowers have been shipped or delivered to our facility and preservation preparation has begun, the booking retainer will be applied to cover preparation labor and materials already performed.

Any additional payments made beyond the retainer will be credited toward the revised order. No additional modification fee will be charged in this situation.

If an order is canceled before flowers are shipped or delivered to our facility, any payments made beyond the $100 booking retainer will be refunded to the original payment method.

Once flowers are shipped or delivered to our facility, preservation work begins. Materials are allocated and production capacity is committed specifically to the project. From that point forward, all payments made are non-refundable.

Because each piece is custom and created using the customer’s own flowers, returns and exchanges are not accepted. Natural variations in color, size, texture, and final appearance are expected and are not defects. Requests for changes after production begins may result in additional charges and adjusted completion timelines.

SECTION 23 - DISPUTE RESOLUTION

You agree to first contact us to attempt resolution. Unresolved disputes shall be resolved through binding arbitration or small claims court in Cooke County, Texas, except claims involving intellectual property rights.

SECTION 24 - FORCE MAJEURE

We are not liable for delays or failure to perform due to events beyond reasonable control including weather, natural disasters, shipping carrier delays, supply shortages, or other unforeseen circumstances.

SECTION 25 - PAYMENT & NON-PAYMENT DISCLAIMER

If an invoice remains unpaid for 60 days from the invoice date, the order enters Holding Status and work and delivery are paused until the account is current.

Because flower preservation is a commissioned custom service, studio workspace, materials, and production time are reserved specifically for each project. A $75 Project Holding Fee is applied at 60 days past due. An additional $75 Project Holding Fee is applied at 90 days past due.

Accounts unpaid at 120 days are deemed abandoned and treated as customer cancellation of a commissioned custom service. The order may be canceled and all payments made are non-refundable due to labor performed, materials used, and reserved production time. Flowers or preserved materials may be discarded due to the organic and perishable nature of the materials and limited storage capacity.

By submitting flowers and proceeding with an order, the customer acknowledges and agrees to these terms.
